Telework is a form of organizing work outside the premises of the employer. Mainly information technologies are used. Conditions for working remotely may be agreed in a collective or individual employment contract. The employer may make a proposal for the transition to teleworking. With respect to the workplace, the worker must provide himself with a specific workplace space in his home or other premises of his choice. The employer is obliged to provide, at its own expense: the necessary equipment for carrying out the work and consumables for the functioning of the equipment; software; technical prevention and maintenance; data protection; devices for communication with the worker who works remotely; a monitoring system, if necessary, with the written consent of the worker only. If there is any damage to the equipment or failure of the used information systems for communication, the employee must notify the employer in the agreed manner and manner. Remote workers have the same rights related to the organization of work and health and safety at work as regulated by the Bulgarian legislation. The employee is also responsible for compliance with the company policy for the organization of work and for safety and health at work, as well as the rules and norms prescribed for health and safety at work. Workers shall not be entitled to refuse access to the workplace when inspected by the institutions concerned, without any justification, during fixed working hours or as agreed in the individual or collective agreement. The working time of the worker must be fixed in the employment contract and equal to the working time determined for the other employees engaged in the activity in the enterprise. As long as you work at a time when the employer and his trading partners are communicating, you have the right to determine your own hours. You choose your holidays only so that they are not detrimental to safe and healthy working conditions. According to the personal contracts with the employer, you can use your leave in the form, order and amount of leave when concluding the employment contract and in accordance with the legal provisions for normal work.
