The owner may assign to another person the right to construct a building on his land by becoming the owner of the building. The owner of the land can transfer ownership of the pre-existing structure separately from the land. Also, ownership of a structure separate from the land beneath it can also be created by voluntary partition.
The owner of the land is also the owner of the buildings and plantations on it, unless otherwise established. The production of the thing, such as fruits, increase from livestock, rent and the like, belongs to its owner.
When a foreign thing is joined as a part to a main thing in such a way that it could not be separated without substantial damage to the main thing, the owner of this thing acquires the right of ownership also over the joined part, subject to the obligation to compensate its owner.
When the right of ownership of a building is established with a term, after the expiry, the ownership of the building passes free of charge to the owner of the land.
The owner of the building may use the land only to the extent that this is necessary for the use of the building according to its intended purpose, unless otherwise stipulated in the act by which the right was assigned to him. The owner of the building may sell it to a third party
The right to build a building on someone else's land is extinguished in favor of the owner of the land by statute of limitations if it is not exercised for 5 years.
