My rights when using the services of a tour operator and a travel agent
tour operator and travel agent
I decided that I should urgently need to take leave from work and go round the country or visit an interesting destination abroad. But I do not care about organizing the excursion itself, searching for guides, reservations. That's why I've given all this care to a tour operator, and I have to wait for the date of the trip and think what to put in my luggage. Yes, but suddenly some troublesome questions arise in my mind and my carelessness melts ...
Which persons are a tour operator and a travel agent and what is the difference?
The trader is a sole trader or legal person (firm) that must meet certain legal requirements and be registered as such. The tour operator organizes, offers and sells individual or group trips for a total price. The travel agent should also meet certain requirements and register. He, in turn, acts as an intermediary of the tour operator and can only offer the tourist trips organized by the tour operator. Apart from this, you can book airline tickets, visa travel services and more.
A person can register for a tour operator, a travel agent, or both.
Conclusion of a contract with a tour operator
Before we get to sign a contract for an organized tour with a tour operator it is necessary:
The Tour Operator, either directly or through a travel agent, will provide me with all the details of the trip, such as the price and method of payment, the start and end date of the trip, the starting point, the final destination and route, the place of accommodation, the number of nights spent on the trip and others. Information can also be published on the company's website as well as brochures.
Before we enter into a contract, the tour operator is obliged to provide me with written conditions.
If the conditions satisfy me, an organized travel contract should be signed between me and the tour operator. The contract must be in writing and a copy of it must be provided to me. With this agreement, the tour operator undertakes to provide me with a tourist trip, and I, in turn, will pay the price. I should be issued a tourist voucher or a reservation form.
The tourist voucher is issued for domestic, inbound and outbound tourism only by a registered tour operator, ie. for a trip in the country or abroad. The cultural voucher is issued in triplicate, except when it is in electronic form. It contains the following information:
1. number and date of issuance of the voucher;
2. company of the tour operator - issuer of the voucher;
3. registration number of the tour operator's registration certificate;
4. number of the registration certificate for tourist agency activity of the person representing the tour operator, except when the voucher is issued directly by the tour operator;
5. names of tourists;
6. the prepaid basic and / or ancillary service or a list of prepaid services included in the organized tourist trip with a total price;
7. the date of performance of the service or the dates for execution of the first and the last service included in the organized tourist trip with a total price;
8. counterparties to perform the service;
9. term and method of payment;
10. name and signature of the employee and stamp of the publisher.
For a tourist service that is not part of an organized tourist trip at a total cost, the travel agent issues a booking form, eg. visit a museum. The form shall be issued after the conclusion of the contract between the travel agent and the provider of the respective tourist service. The reservation form shall be issued in triplicate, except in the form of an electronic document. It contains the following mandatory data:
1. number and date of issue;
2. company and registration number of the travel agent;
3. names of tourists;
4. the type of the main or the additional tourist service;
5. date of performance of the service;
6. name and signature of the employee and stamp of the publisher - does not apply to electronic reservation forms, in which case only the name of the employee is written.
What are the duties of the tour operator and the travel agent in performing the contract?
Tour operators and travel agents have the following obligations in connection with the performance of the contract between us:
The tour operator is obliged not to change the agreed price of the organized trip, except in the cases explicitly mentioned in the contract. The good news is that the cost of organized travel can be reduced.
The tour operator is obliged to keep the contract concluded between us for 3 months from the date of its conclusion.
After the conclusion of the contract but no later than 7 working days before the date of departure, the tour operator shall, directly or through a travel agent, provide me in writing with information on:
