My rights to a loan with a pawnshop
Once I have read in detail the rules for the conclusion of a loan agreement in a pawnshop and concluding such a contract, I must be provided with a copy of the pledge ticket which the Pawnbroker is obliged to issue upon the writing of the loan agreement against a pledged item . This ticket has its own ID number and contains:
the name of the pawnshop, UIC on the Bulstat register, and the names of the pawnbroker's trading manager;
the exact address of the business premises in which I enter into the contract;
my personal data - names, PIN, address (permanent and current), identity document number;
loan amount, amount of monthly interest on it;
the term of the loan and the date on which it must be returned;
description of the thing I have set up - type, brand, model, year of production, serial number, etc. identifying features;
other loan terms, if any;
I have my own names, and then I sign.
What rights arise for me after the loan agreement against a pledge is concluded?
I have the right to ask for my item to be kept in a separate package marked with the ticket number. Storage must be done in the premises of the pawnshop or dedicated vault; Vehicles are kept in guarded parking lot;
Attention! The Pawnbroker can only keep the item, she can NOT use the item (if it is a mobile phone, can not talk to him);
I have the right to check at any time where, how, and under what conditions, the item I have stored is stored.
Attention! In the event that the Pawnbroker does not properly store the property or use it in any way, I have the right to withdraw my pledged item, with the remaining arrangements for the loan agreement remaining in effect. (!)
I have the right to receive compensation if the property stored by the pawnshop is damaged or destroyed. This responsibility of the pawnshop is only ruled out if the damage is due to force majeure (earthquake, flood, etc.).
I have the right to transfer (sell) the object of the bet when I own it. To do so, I have to go to the pawnshop where I have handed over the property to ask for the transfer, for which a specific protocol will be drawn, which will also be entered in the Pawnbroker's Register. I need to pass the betting ticket to the new owner of the item.
I have the right to ask for a duplicate to be issued to me when I lost it, it was destroyed or stolen. For this purpose, I need to go to the Pawnbroker immediately, where a ticket for issuing a duplicate ticket will be drawn up.
I have the right to repay the loan amount in advance without incurring additional (other than pre-agreed) fees or interest on the early payment.
I have the right to a receipt for each installment under the loan agreement I am making. The receipt is a document certifying that the Pawnbroker has received the amount transferred, part of the repayment installment. I can legitimately refuse to pay my contribution if the pawnbroker refuses to give me a receipt for payment.
I have the right to get back the pledge as soon as I have repaid the entire loan together with the interest and the due fees.
What are my rights in case I do not pay the whole loan amount?
I have the right to repay the entire loan amount within 7 days of expiration of the loan repayment date agreed with the contract, together with the accrued interest and the due fees, after which I can get my property back.
Attention! In the event that it does not return the amount of the pawnbroker loan, it has the right to:
- sell my pledged item when it is worth less than $ 5,000 by retaining the amount of the loan agreement I have not repaid, together with the accrued interest and the due fees under this contract. This can happen after 7 days from the date specified in the loan agreement for its return.
- Withdraw a writ of execution together with an Order for Immediate Execution under the Civil Procedure Code and hand over the property to a bailiff if the value of the pledged item is over BGN 5,000. For this case, reference "My rights in receiving a performance order ".
I am entitled to receive the difference between the price of the sold item and the amounts due on my part under the loan agreement when the sale price is higher than the amount I owe the pawnhop (the amount borrowed by me plus the interest plus the fees , including charges for enforced enforcement). Payment of this difference must be made within 30 days after the sale of the item I have placed.
