Job appropriation is a deliberate crime that belongs to the so-called "criminal misappropriation". In appropriations, the subject of the crime exercises factual authority over the property on a specific legal basis, in contrast to the theft in which the offender derives actual power from the owner. management in that capacity to which the property is served or entrusted with safekeeping or management in that capacity. An official who misappropriates another person's money, possessions or other valuables, or is entrusted with protecting or managing them, shall be punished by imprisonment for a term up to eight years, and the court may order confiscation up to one-half of the property of the guilty party and deprive him of rights. The object of the job assault is complex and it covers: • Public relations ensuring the proper exercise of property rights. • Relations in the service in which the subject of the crime is involved, because at the same time as the assignment, the perpetrator also breaks his or her official duties. The subject of the crime may be a criminal responsible person who holds the status of "official". The subject of the encroachment may be foreign money, movable and immovable property or other valuables. The object of the crime must be served on the official or entrusted to him or her to keep or manage them. It is not necessary that the service or the order be entrusted with a formal written act. It is sufficient for the official to have performed his functions of keeping or managing the property. The enforcement act is carried out by misappropriation of the object of the crime. Misappropriation constitutes disposing of property as one's own without being entitled to do so. The offender turns the holding of the other into a possession for himself. The order may be legal or factual, in its own right or in its own interest. The crime committed is effective. It is complete when its owner is deprived of the opportunity to use his property. For job posting, the punishment is imprisonment for one to ten years: 1. If another crime has been committed to facilitate it, for which no more severe punishment is provided for by law; 2. If made by two or more persons who have agreed in advance. For job posting, the sentence is imprisonment for three to fifteen years: 1. If it is large in size; 2. If it represents a dangerous recurrence; 3. If the appropriations are from funds belonging to the European Union or provided by the European Union to the Bulgarian state. For particularly large-scale job placement, which is a particularly grave case, the sentence is imprisonment for ten to twenty years. The court orders the confiscation of all or part of the perpetrator's property and deprives him of his rights.
