How do I make a donation? (donation contract)
I would like to express my gratitude or appreciation to my close relative or friend, or there is an occasion where, according to the Bulgarian tradition, gifts are made, such as a birthday, wedding, christening or illumination of a home. In all these cases, when I choose to donate a movable item or property, I will have to make a donation contract. The following material is intended to introduce me to the basic rules when concluding such a contract.
Donation is made in cases where, as a donor, I want to transfer ownership of one item to another person free of charge without expecting any particular behavior in return. Filing a thing requires, besides my consent as a donor, the consent of the gifted, for no one can be endowed against his own will.
Who can be endowed?
Any person, whether natural or legal, can be endowed, it is only necessary to express his or her consent to the gift in order to make this transaction legal.
When donating to a person below the age of 14, the consent of a parent or other legal representative is required.
When a donation is made to a person who has attained the age of 14 but has not reached the age of 18, the consent of the donated and the consent of his parent or other legitimate representative is required. When the subject of the donation is a small thing to satisfy the current needs of the child, such as a school supplies or a garment, parental consent is not necessary.
Where a legal entity donation is required, the consent of an authorized representative of that person is required.
Who can donate?
Only an adult person who is not limited in his / her right to dispose of his / her property. A donation made by a person who is not 18 years old is null and void.
When donating a political party, the donor must be a natural person who has revealed his identity.
