Nature of control points
The checkpoints, which are received by each motor vehicle driver upon obtaining a driver's license, serve as a record of the violations committed by him of the ZdvP.
Number of checkpoints
Upon initial issuance of a motor vehicle driving license, each driver receives 26 checkpoints, and after acquiring 24 months of experience as a motor vehicle driver, the holder of a motor vehicle driving license receives an additional 13 checkpoints.
The maximum number of checkpoints for reporting violations of the Road Traffic Act (Traffic Act) is 39.
Restore the number of control points
Restoring the number of checkpoints can be done in 2 ways:
- by a partial increase by 1/3 of the maximum number of points after passing additional training, but not more than once in a period of 1 year, provided that the driver has fulfilled his obligations to pay the fine imposed on him;
- ex officio, after the expiration of two years, counted from the date on which the last criminal decree entered into force, by which the driver was deprived of control points.
When can checkpoints be taken away from a non-motor vehicle driver?
Checkpoints are ONLY revoked based on an effective criminal decree, which reflects both the number of revoked and the number of remaining checkpoints.
List of violations for which control points are taken away
For violations of the Road Traffic Act, motor vehicle drivers will be subject to checkpoints as follows:
- for driving a motor vehicle, tram or self-propelled machine with a concentration of alcohol in the blood of more than 0.5 per thousand to 1.2 per thousand inclusive, established by a medical examination and/or by a technical means determining the content of alcohol in the blood by measuring it in exhaled air - 10 control points;
- in case of repeated violation of the above-mentioned violation - 15 checkpoints
- for the refusal of a driver who drives a motor vehicle, tram or self-propelled machine to be tested with a technical means to determine the use of alcohol and/or narcotic substances or their analogues or fails to comply with the prescription for a medical examination to determine the concentration of alcohol in his blood and/or the use of narcotic substances or their analogues - 12 control points
- for driving a motor vehicle on which the plates with the registration number are not placed in the designated places - 8 checkpoints;
- for driving a motor vehicle that is not properly registered or is registered but does not have plates with a registration number - 10 checkpoints;
- for violating the rules for crossing a railway crossing - 5 checkpoints;
- for exceeding the permitted maximum speed by more than 50 km/h in a populated place or when carrying out public transport of passengers and dangerous goods - 12 checkpoints;
- for not stopping at a road sign "Stop! Let pass the road users with priority!" - 8 control points;
- for using a mobile phone while driving the vehicle, except for the presence of a device allowing the use of the phone without the participation of his hands - 6 control points;
- for failure to fulfill the obligation to use a safety belt or to wear a helmet - 6 checkpoints;
- for transporting children in violation of the requirements of the law - 6 checkpoints;
- for crossing at a traffic light signal that does not allow crossing - 8 checkpoints;
- in case of repeated violation of the above-mentioned point - 12 checkpoints;
- for not providing priority when crossing a pedestrian path - 8 checkpoints;
- in case of repeated violation of the above-mentioned point - 12 checkpoints;
- for improper overtaking, if this creates an immediate danger to traffic - 10 checkpoints;
- for movement in the oncoming traffic lane on the highway or expressway - 10 checkpoints;
- in case of repeated violation of the above point - 12 checkpoints.
