The complaint of a good or service is an opportunity that arises in the relationship between a trader and a consumer of a service, when after delivery, initial inspection or storage, installation, testing or operation discrepancies are found between the agreed and actually received goods or services.
Every consumer has the right to complain, regardless of whether the manufacturer or trader has provided a commercial guarantee for the purchase.
- the consumer has the right to receive a good or service that complies with the contract;
- the consumer has the right to receive a replaced product or service;
- the consumer has the right to receive free repair of the goods;
- the consumer has the right to reduce the price in case of partial performance of the service or to cancel the contract and refund the amount paid
The Merchant is responsible for any non-compliance of the service that exists during the provision of the service and occurs within two years after its provision, but not later than 14 days from the establishment of non-compliance with the contract.
Every user has the right to file a complaint, both to the trader and to any other person authorized by him. The complaint is submitted orally or in writing.
When filing a complaint, the consumer indicates the subject of the complaint, his preferred way to satisfy the complaint, respectively the amount claimed, and contact address, and must attach documents proving his claim:
If the complaint is made in time and according to the requirements of the law, each trader or a person authorized by him is obliged to accept it. A register is maintained for the received complaints and a document is issued to the user, which contains the date, the number under which the complaint is entered in the register, the type of service and the signature of the person who accepted the complaint.
Upon satisfaction of the complaint, the trader issues an act to that effect, which is drawn up in two copies, and must provide one copy to the consumer.
In addition to filing a complaint, each user can seek their rights through the courts.
