Adoption is a legal act, a procedure in which a relationship is created between a minor and an adult, like between a child and a parent.
Apart from between the two, relations also arise between other relatives depending on the type of adoption.
An adopted person can only be one who, when applying for adoption, has not reached the age of majority/ 18 years/
• An adoptive person can only be one who has reached the age of majority and has not been deprived of parental rights by the court;
• The adopter must be at least 15 years younger, at least than one of the adopters /in case there are two/;
• Anyone who is not directly related to the adoptee / mother, father, grandmother, grandfather / or brother or sister can adopt.
In case of incomplete adoption, rights and obligations arise only between the adopted person and his children and grandchildren, on the one hand, and the adopter - on the other, and the rights and obligations between the adopted person and his children and grandchildren and their blood relatives are preserved.
The adoptive parent is the one who also acquires parental rights and obligations over the adopted person.
In the case of full adoption, between the adopted person and his children and grandchildren, on the one hand, and the adopter and his relatives, on the other, legal relations are created, as between blood relatives, and the rights and obligations between the adopted person and his descendants and their relatives by origin are terminated.
A new birth certificate is drawn up, in which the adoptive parent is entered as a parent. The act is drawn up by the civil status official in the municipality, town hall or district at the permanent address of the adopter, and when there are two adopters - at the address specified in the court decision.
When a child is adopted by a parent's spouse, all existing rights and obligations are preserved. In the child's existing birth certificate, in addition to the birth parent's data, the adopter's data is entered, and depending on the type of adoption, different rights and obligations arise between them.
After the full adoption, the "Social Assistance" Directorate at the current address of the adopter monitors how the child is raised for two years.
Upon termination of the adoption, all resulting relationships are terminated.
The competent court to terminate the adoption under existing circumstances is the District Court
No one can be adopted by two persons, unless they are husband and wife!
