    Actual cohabitation, also known as family life, is a situation in which a couple shares housing, finances, property, etc. but does not have a marriage. In actual cohabitation, the husband and wife do not take on all the obligations and risks that marriage entails. It does mean, however, that they cannot benefit from the benefits and protections of marriage. Here are some of the main differences between actual cohabitation and marriage: In a family life, you can end cohabitation at any time. If you are married, you should divorce. When you are in actual cohabitation, the parent taking care of the children is not entitled to claim the use of the family home if it is the property of the other parent or a third party. In divorce, this opportunity exists. In actual cohabitation you have no right to seek maintenance, but in divorce you may claim maintenance. In actual cohabitation, the father must recognize the child. A family child cannot adopt a child while two spouses can. Actual cohabitation is uncertain. There is no document to prove actual cohabitation. If you have to prove it, you will have to rely on family and friends who can testify to the existence of cohabitation. In case of termination of the actual cohabitation, the man and the woman can make a decision about the dependent child, who to live with, how much time to spend with the other parent, etc. If they are unable to decide on their own, they must appeal to the district court at the child's current address. Actual cohabitation does not produce property consequences such as those of marriage. The property acquired during the actual cohabitation is not common but is the property of the person who bought it. If a man and a woman understand how to share common property there will be no problem. In case of misunderstanding of the division of the common property, a claim can be filed and a case for division may be brought.
