International and European development require amendments to Bulgarian law

The petitioner points out that since Bulgaria is an EU Member State, the provisions of the Convention of 23 November 2007 on the International Recovery of Child Support and Other Family Members adopted by the Hague Conference on Private International Law . In this regard, the Council of Ministers proposes the establishment of internal procedural rules for the application of the international legal norms through a bill for amendment and supplement of the Civil Procedure Code. Thus, Bulgaria will become part of a common legal and judicial area based on the principle of mutual recognition of judgments given in States applying the Convention's rules. Its purpose is to ensure the effective recovery of child support and other family members, regardless of whether the maintenance obligation has arisen in a particular country under the application of a given national law by the competent jurisdiction of that country, and enforcement requires action in another country. Particularly important is the requirement to provide access to justice to a person seeking the actual receipt of maintenance in a State Party.
