The Council of Ministers proposes the introduction of rules on recognition and enforcement of judgments and issue a European certificate of inheritance, based on Regulation (EC) № 650/2012 of 4 July 2012. This act shall apply with respect to succession of persons who died on August 17, 2015 or after that date, lays down uniform rules on jurisdiction and applicable law in matters of succession within the EU, and recognition and enforcement of regulations in this area. The new provisions define the court before which the interested party may request recognition of a foreign judgment and enforcement of a judgment, and that the courts before which they can appeal the orders of the court.
Draft Law on the Civil Procedure Code envisages the speedy and efficient settlement of succession with cross-border implications within the Union heirs, legatees having direct rights in the succession and executors of wills or administrators of the estate, which is required in another Member State to invoke their status or to exercise their rights to request the issuing of a European Certificate of Succession competent to issue a county court in the last domicile of the deceased.
