Since the beginning of 2017 came into force amendments to the Labor Code, which provides better protection of the Bulgarian workers posted in the European Union. The new texts introduced requirements of the European directives governing cases of posting and the posting of workers from one to another Member State of the EU in the European Economic Area or Switzerland.
Was introduced requiring employers to provide employees posted at least the same minimum working conditions as established in the host country for employees performing the same or similar work. The requirements relate to maximum work periods and minimum rest periods, minimum number of paid annual holidays, minimum rates of pay, including overtime.
Entered into force provisions that enable posted in Bulgaria workers to file a lawsuit against their employer if they have suffered damage due to non-compliance with the minimum working conditions laid down in the Labor Code. Employers can not treat these adverse employees. Claims can be made after termination of employment.
