System of state authorities

 

 

In the system of functional units of the state mechanism, we have to find the authority according to several criteria:

 

 an organizational structure that is characterized by a certain personality (a person - person or a number of persons with a particular legal status - a set of powers that determine their competencies).

 

The state body has been set up to realize its powers, right-obligation. The State body is obliged to exercise competence, it is obliged to consider the matter, there are certain deadlines. The principle of tacit consent and tacit refusal exist.

The state authority issues acts, voices in legally significant acts of the state - individual, general and regulatory administrative acts

 

State bodies are elected and appointed. Elections are related to the democratic idea of ​​mandate. They are constituted and operate within a reasonable time. If the mandate is long, it is reasonable to be one-time, and if it is short, it is reasonable to be multiple. In terms of composition, the bodies are single and collective. The quorum is the minimum number of members required to discuss a matter of its competence. Where there is a collective body, the majority is important. A majority in the quorum of political decision-making is needed. Qualified majorities are foreseen for the realization of many important competencies.

The state authority differs in territorial scope from central and local authorities. Distinguish between senior and local in a hierarchical subsystem of organs. They have general or special competence. There is no authority in the constitutional state where the functions are divided, which can have everything, have absolutely any competence. The Ombudsman is a state authority with competence but without the authority to issue administrative acts.

 

The CP has a tendency - an institution is always sought to supervise the guards. CC has no supervisors - their acts are final in the name of the rule of K.

 

The State Authority is an institution that is set up to manage. Powers are explicitly recorded in a law, and credentials are legitimate for participation in government. Powers are the empowerment of a law, stemming from the will of the authority that elects or takes power.

System of state bodies - unity of interconnected and interacting bodies that function in a given social environment.
