ABOUT THE LAW ON ROAD

§ 3. A new art. 178zh follows:
"Punished with deprivation of the right to drive a motor vehicle
means for a period of six months and a fine of 3,000 lev leader who
moves in the opposite traffic lanes on the highway and speed road. "

Motives
the bill of the Law on Road
roads
The proposed changes to the Law on Road
roads are caused by the fact that recently became more frequent cases
which vehicles are run in lanes counter
movement of motorways. Such acts constitute strongly
violation of the rules for the disposal of non-rail vehicles
on the road, for road use and obey
road signs and road markings. Under the current
administrative penal provisions in ZDvP, the analysis of case
practice on the matter established that drawing up the statements, respectively
administrative and penal authorities and the court, qualify this act as
violation of rules for use of the roadway. Provided
penalty is a fine of 20 to 150 lev
Since the rules were formulated too general, provided
sanction definitely does not meet the degree of public danger
reveals that the act when committed on a motorway. For his
country harakteritikite gear time under current
legislation are almost identical to those of the highway, namely -
These are ways in which the movement takes place under special rules and their main characteristic is that they are designed for high speeds.
Therefore, the probability of causing serious consequences is
extremely high.
The proposed amendments create a separate, special composition
administrative violation while driving in lanes for oncoming traffic
motorway and express road, with significantly higher penalties.
The main objective is to protect the life and health of road users
road, to reinforce the educational and warning
impact of administrative punishment to all drivers and so
actually provide general prevention that any sanction should
to have.
Given the extremely high degree of public danger which
This act reveals proposes the introduction of cumulative penalties
in its commitment. Specified duration and amount of deprivation
law and fine stem from the belief that regardless of the specific
terms of time, place and situation any such case reveals
extremely high risk of realizing
accident and with very serious consequences.
The bill does not incur costs for the state budget and not
concerns the areas of competence of the European Union.
