My rights in theft

Indeed, in addition to swearing, it seems to me that I also have rights regulated by law. Here are some helpful tips on how to do it after someone has "shrunk" something from me.

Here I will get acquainted with my rights in the theft of only movable property (eg wheel, computer, camera, etc.). Still, stealing real estate would be a very laborious task for the thief. Besides carving a huge hole in my property and leaving with a big bag of finger, there is no other way to hurt me. On the other hand, entering the window for the purpose of stealing my kitchen utensils (movables) is a fully feasible action.

Special types of theft:
  • theft of personal documents, credit and debit cards;
  • theft of motor vehicles;
  • theft of weapons. I have to report to the police about the theft of arms. Otherwise, I can very quickly turn into a hero of "From the crime scene". It would not be cheerful if murder had been done with my stolen weapon.
NB! Energy (electric and thermal) is also a movable property, which is why it can be stolen.

Theft of things in the sense "came out of my sight"
It's theft of things if I have no idea who the perpetrator is.

If it is broke into my home, the most important thing to remember is:

I have to call the police, report the crime and wait for them to come to my house.
I should not change anything in the scene at all, so that the MoI team can do their job and gather the necessary criminological traces.
If material damage from the theft is not excessively high, the MoI will most likely not take the perpetrator's DNA profile.
In the case of stealing my movable property, it is competent to deal with the case with the relevant police station in the area of the crime. I can file a complaint with the police station, where I believe is the alleged crime scene. If I do not know where my stolen thing is, the complaint is filed with the police station at my current permanent address.

I can file a complaint about the theft of my belongings and directly in the prosecution service. The appeal is filed with a regional prosecutor at my current permanent address. Forms for complaints are available on the official websites of most prosecution offices in the country. I have the right to appeal the District Prosecutor's Office's reply to a regional one within 7 days.

It would be useful if I attach documents for the purchase of specific items or at least serial numbers. It is important to describe the items. If they have permanent scars, it is good to describe them.

I can name witnesses and reasons for their questioning, eg. if I know for sure that the neighbor was in her apartment at that time.

Theft of things in the sense "Just fall to me!"
This is theft of things if I guess who the potential perpetrator is.

A person who steals a movable item can not acquire it by a prescription, that is, the thief will never become her (at least official) owner. Although my bike, for example, is in strange hands, and who knows who he is, I'm the official owner of the wheel. I will have the right to ask for the wheel in the next 3 years of the theft. After this period, I can not protect my right to property. More on the subject of stolen things I can find here.

So if, thanks to the law enforcement or the magic of sight, I can figure out who stole my bike, I will always have the right to ask the thief for the return of my wheel.

If I know or guess who the thief is, I must describe it in my complaint to the police (or possibly to the prosecution).

It is not stealing or losing anything if I, as the owner, pass my holdings to the hands of a third person, who subsequently does not want to return it to me. These are so. assignments and occupations of belongings. They are raised in crimes in the sense of the Criminal Code and are also punishable. If a person I have given to keep my thing does not want to return it to me, I have the full right to complain to the police. Then, in the complaint, I will also have to describe the name of the perpetrator.

In general, the option of being robbed is in direct proportion to what I own. Naturally, preventive measures are preferable, but that does not mean I should not seek and defend my rights after the crime
