Exemption from court fees and costs
In order to guarantee and protect the legal rights and interests of every citizen of the Republic of Bulgaria, the law details the conditions under which court fees and costs are not paid by the parties to the proceedings, namely: if the claimants are employees, employees and members of cooperatives , on claims arising from employment relationships; if the claimants are claiming maintenance; for actions brought by a prosecutor; by the plaintiff-on actions for damages for unlawful injury from a crime for which a sentence has entered into force; by the court-appointed special representatives of a country whose address is unknown. Persons who do not have sufficient means to pay the court fees and costs may also be released from this obligation by the court. They apply to the court for release from them. They enclose written evidence of 1. the income of the person and his family; 2. the property, certified by a declaration; 3. the marital status; 4. health status; 5. employment; 6. age; 7. other established circumstances. By order of December 27, 2019, the Supreme Court of Cassation determined that upon filing an application for release of a person from payment of a state fee, with enclosed written proofs, the applicant's financial and material status together with a statement of the same / NO. before deciding on the request to instruct the petitioner to adduce further evidence, but to rule only on the basis of the evidence already presented.
