The green area is municipal property. Because the municipality is the owner, it is responsible for incidents. Therefore, the municipality is responsible for the fallen tree. Provided you have insurance, the insurance company will pay the compensation, and it will in turn claim it from the municipality. You can get compensation by filing a lawsuit with the district court. You can file a claim no later than five years after the injury occurs. If you have contributed to the disability you will not receive full compensation. You should also be aware that if the fall of the tree is due to a storm or strong wind, the municipality is not responsible. In case of damage to the vehicle due to a non-signaled hole in the road, you may seek compensation from the state or municipality. They are responsible for maintaining the roads and therefore owe compensation as owners in the event of such damage. The state shall be liable in the event of damage to a republican road. When you get into a hole in a municipal road, you must seek compensation from the municipality that owns the road. The prerequisites here must be: damage to your car; it is caused by the thing (the path) and the interconnection between them. Immediately after the incident, you should call a Road Police officer who will draw up a road accident report (PTP) for you. The record serves as evidence in court of the damage caused. You again file a claim with the district court in whose area the accident occurred within five years of the accident. If you break your legs because of an icy sidewalk, the municipality owes you compensation. Why? Because it is the municipality's duty to maintain the sidewalks. After the fall, it is a good idea to see a doctor who will issue you an ambulance sheet to serve as evidence in court. You receive court damages in the district court within five years of the incident. In the event that you suffer from falling objects from unremarked buildings in repair, you have the right to seek compensation from the owner, even if someone else does the repair work. The owner can be in addition to the state and the municipality, but also a natural or legal person. You again file a claim in the district court in whose area the incident occurred. Remember the period of five years from the incident.
