In order to realize insurance rights, Bulgarian legislation makes provision for the existence of a certain length of insurance period, which is in direct connection with the acquired work experience. For the purposes of the Act, length of service is the time during which the employee has worked under an employment relationship. Work experience is also the length of time that a civil service or employment relationship is carried out under the legislation of another Member State of the European Union or a State party to an agreement on the European Economic Area or in the Swiss Confederation as well as the length of time it is occupied a position in an EU institution certified by an act of origin and termination of the legal relationship (the legal basis for this is contained in the norm of Article 351, paragraph 2 of the Labor Code). If, in the exercise of his right to benefits or pensions, a person wishes to receive a retirement pension, acquired in another. States, it must produce documents proving it.
The following documents are required:
Application for the issuance of a certificate of retirement in an EU Member State or in a country with which Bulgaria has a social security agreement to be filed with the European Integration and International Treaties Directorate with the National Social Security Institute. The application shall state the personal data of the person in Cyrillic and Latin characters as recorded in the identity documents. The application shall also indicate the country to which the certificate requested and the purpose for which it is requested are to be served. It is permissible not to be personally filed by the person concerned but by a proxy with a notarized power of attorney. All documents certifying foreign retirement age are attached to it. If the internship is applied in a country that is a member of the EU, please provide:
• Certificate E 104, which provides information on aggregation of periods of insurance, periods of employment or periods of residence / maternity / maternity / death / benefits / invalidity /. It is issued by a competent institution of the EU Member State in which the insurance practice is acquired. It can be sent by the NSSI, ie it is not necessary for the person to complete it and prepare it only.
• Certificate E 301 - it relates to the periods to be taken into account for the granting of unemployment benefits. Issued by the competent institution of the EU Member State in which the length of the insurance practice is acquired. It can be sent by the NSSI, ie it is not necessary for the person to complete it and prepare it only.
• Certificate E 207, which summarizes the insurance history of the insured person. This certificate is only to be filled in if a pension application is submitted.
• Other information on insurance periods not covered by the EU Regulation 1408/71 and EU Regulation 547/72.
In the majority of cases, in order to be recognized in Bulgaria documents issued abroad, it is sufficient that they are certified by apostille by the relevant foreign state authority. After its placement, the document should be translated into Bulgarian and certified at the Ministry of Foreign Affairs in Sofia. Apostille documents are recognized in each of the States Parties to the 1961 Hague Convention, and Bulgaria. In cases where a legal aid contract exists between the state issuing the documents and Bulgaria, there is no need to place an apostille on the specific document. However, it leaves the requirement to translate into Bulgarian and to be credited to the Ministry of Foreign Affairs in Sofia (list of countries with which Bulgaria has a legal aid contract published and publicly available on the MFA website).
Information about the movement of the procedure for certifying the length of his insurance experience acquired abroad, each citizen can receive from the NSSI. Obtaining the so-called personal code by which every person can monitor their online insurance is a great convenience and saves time. This code can be obtained from any of the nearest territorial units of the NSSI or its affiliated company only against an identity card. The code can not be mailed, so it should be obtained personally or by proxy with a notarized power of attorney.
The National Social Security Institute does not certify a period of insurance from countries which are not EU Member States or with which there is no international agreement in the field of social security, to which the Republic of Bulgaria is a party. Unfortunately, our country does not currently recognize any insurance experience acquired in the United States despite the large number of our compatriots there
As a result of the certified length of service, the entitled person may exercise his / her insurance rights in the Republic of Bulgaria and receive indemnity for incapacity for work, unemployment benefit or pension.
